Terms of Service
These terms govern your use of EviDiary. By creating an account or using the service, you agree to these terms.

1. The service
EviDiary is a private workplace-recording service operated by EssorAWD, designed to help users record incidents, preserve evidence, organise cases and produce structured chronologies and reports.
EviDiary is an organisational tool. It does not decide whether conduct is unlawful, does not verify the truth of an allegation, and does not provide legal, HR, union, medical or professional advice.
2. Your account
- You must provide accurate account information and keep access credentials secure.
- You are responsible for activity carried out through your account unless caused by a failure for which EviDiary is legally responsible.
- You must be legally capable of entering into this agreement. If you are under 18, you should use the service only where legally permitted and with appropriate adult or guardian involvement where required.
- Do not share an account in a way that undermines the privacy of the workplace records stored in it.
3. Your records and evidence
You retain responsibility for the records, text and evidence you add to EviDiary. You grant EviDiary only the rights reasonably necessary to host, process, secure, display, export and otherwise provide the service you request.
- Record information honestly and as accurately as you reasonably can.
- Do not knowingly upload unlawful material, malware or content that you have no lawful basis to possess or process.
- Be particularly careful with information about colleagues, witnesses, health, allegations, disciplinary matters or other sensitive subjects.
- Do not use EviDiary to harass, threaten, stalk, impersonate or unlawfully monitor another person.
- Keep original source material where appropriate. Generated reports, SHA-256 hashes and Case Freeze snapshots organise your records but do not independently prove that an event occurred.
4. Free and paid features
EviDiary may offer a free plan, recurring Plus subscriptions and one-off Case Pack purchases. The price, billing period and included features shown at checkout form part of your purchase.
The current planned launch prices are £4.99 per month or £39.99 per year for EviDiary Plus, and £14.99 for a one-off Case Pack for one selected case. A Free plan remains available for core recording and privacy functions.
Recurring subscriptions continue for successive billing periods until cancelled. Cancellation stops future renewals; unless the law or checkout information states otherwise, paid subscription access normally continues until the end of the current paid period.
One-off Case Pack access applies to the selected case and does not create a recurring subscription.
5. Payments
Payments are processed by Stripe through Lovable's managed payment infrastructure. EviDiary does not store your full payment-card number in its application database. Payment processing is also subject to the payment provider's applicable terms and privacy information.
If a payment fails, is reversed, refunded or disputed, EviDiary may suspend the corresponding paid entitlement. Existing workplace records will not be held hostage because a paid plan ends: records remain available subject to the normal service and account rules, although premium creation tools may become unavailable.
6. Cancellation and refunds
You can cancel a recurring subscription using the available billing-management controls when billing is active. Refunds and statutory cancellation rights are described in the Refund Policy, which forms part of these terms.
7. Availability and changes
We aim to keep EviDiary available and secure, but uninterrupted availability cannot be guaranteed. Maintenance, provider outages, security events or technical faults may occasionally affect access.
We may improve, replace or discontinue individual features where reasonably necessary. We will not intentionally use a feature change to prevent you from accessing or exporting existing records without reasonable notice, except where immediate action is required for security, law or abuse prevention.
8. Acceptable use
You must not attempt to bypass authentication, row-level access controls, payment entitlements, storage limits or other security mechanisms; interfere with the service; probe other users' data; automate abusive traffic; or use the service for unlawful purposes.
9. Intellectual property
EviDiary's software, branding, interface, documentation and service-generated templates are protected by applicable intellectual-property laws. These terms give you a limited right to use the service; they do not transfer ownership of EviDiary's software or branding to you.
You remain responsible for and retain any rights you have in your own diary content and uploaded evidence.
10. Closing or deleting an account
You may use the in-app account deletion function to request permanent deletion of your EviDiary account and application data. Export anything you need before deleting the account. Some limited billing, fraud-prevention or legal records may need to be retained where required by law or legitimate dispute-handling obligations.
If an active paid subscription exists, you should cancel it through billing management before deleting the account so that future billing is not left unmanaged.
11. Liability and statutory rights
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, or affects rights that UK consumer law does not allow to be excluded.
EviDiary is not responsible for employment, legal, disciplinary or other decisions made by you, an employer or a third party based on your records. You should obtain appropriate professional advice for decisions that require it.
To the extent permitted by law, EviDiary is not responsible for indirect or unforeseeable losses arising from use of the service. If you use EviDiary as a consumer, these terms do not remove your statutory consumer rights.
12. Governing law
These terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you retain any mandatory rights and court protections available in the part of the UK where you live.
